운명을 믿으시는가?

찰라의 우연이 결정하는 타고 난 운명.

얼마 전에 한국 TV 사극이 보고 싶어 찾다가, 전 인화 – 강 수연 이라는 황금 배역이 있어 시간 죽이기 겸 보기 시작했다. “여인 천하”라는 연속극, 거기 관상도 보고 사주도 보는 배역이 하나 등장하는데, 길에서 시골 처녀 전인화를 우연히 지나치면서 보고는 갑자기 넙죽 엎드려 “아~이이~~고오, 중전마마”라 하질 않나, 생년월일을 받아 놓고 눈을 지그시 감으며 손가락을 짚어 가면 생년월일 임자의 운명이 그대로 눈앞에 펼쳐지질 않나... 사주 팔자, 요넘은 미신이라 하고, 조넘은 통계의 일종이라 하고 그거 뭔가?

전인화 넘 괜찮지!

사주라는게 한자로 4개 기둥인데 바로 생.년.월.일.을 말하는 거고, 그 생년월일을 풀어 보며 당사자의 운명을 연구하는 것이 사주. 고상하게 말하면 명리학이라는 거다. 그러면 꾀돌이 엄니는 “그람, 내 산달이 낼 모렌디, 좋은 날 잡아 배 째야 것네” 할지도 모른다. 그런데, 그건 아니다. 그 날짜가 사람의 운명을 결정한다는 것이 아니라, 어차피 정해진 운명을 생년월일로 풀어 본다는 것이니까 (이건 순전히 내 생각이고 명리학에 맞는지 틀리는지도 젼혀 모른다)

어쨋든 그넘은 (아 실례, 이름이 생각나질 않는다) 부적으로 횡액을 피하거나, 아들을 낳게 하거나 하는 처방까지 하는데, 운명을 부적으로 비껴간다? 이거 말이 안돼지. 부적으로 어떤 횡액을 비껴 갈 수 있다면, 어쨋거나 횡액을 당하지 않는 것이 바로 니 운명 아닌가 말이다. 그러니까 사주쟁이가 뇨의 운명이 어떻다 라는 말만 해야지 어떻게 하면 다르게 풀려갈 수 있다는 것은 사기란 얘기다. 그런 얘기 한 토막 해 드릴까 한다.

때때로 현실이 가상의 소설보다도 더 희한한 경우가 많다. 어쩌면 우연이 그렇게 현실 속에서 필연적으로 되는지 참 놀라는 경우도 있다. 내가 앞서 말한대로 운명은 (부적으로든 뭐로든) 비껴 갈 수가 없다는 얘기다. 기가 막힌 우연의 장난으로 자기의 정해진 운명에 따를 수 밖에 없었던 한 싸나이의 얘기 들려 드린다. 물론 이 땅에서 일어난 실화다. 이 얘기는 미국 법의학회 (Frorensic Science)에서 발표된 어떤 희한한 죽음과 이에 대한 얽히고 섥힌 복잡한 법 적용에 관한 얘기지만, 운명이라는 화두로 얘기를 풀어 나갈 수 있어 들려드리는 거다. 찰라의 우연이 숙명적이었던 이 이야기가 주는 교훈은 각자 새길 일이다.

이러지 않아도 갈 운명이면 다 가게 돼있어!

Ronald Opus 라는 사람의 시체가 발견됐는데, 머리에 총을 맞아 죽었고 10층 옥상에서 자살하려고 뛰어 내린 사람이었다. 10층에서 뛰어 내렸는데 9층을 지날 때, 방에서 발사돼 창문을 뚫고 나온 총알에 맞아서 즉사했다는 것이다. 그런데 그 빌딩 8층 쯤에는 안전 그물이 있었다는 것. 물론 총을 발사한 사람이나 Ronald Opus 는 안전 그물이 쳐져 있는지 몰랐고. 그때 우연히 발사된 총을 맞지 않았다면 그는 자살 목적을 이룰 수 없었다는 얘기다.

법적으로 이것이 자살이냐 타살이냐의 문제인데, 통상적으로 자살을 기도한 사람이 그가 의도한 대로 죽지 않아도 결과적으로 죽었다면 자살로 인정된다고 한다. 하지만 누군가가 쏜 총에 맞아 죽었으니 타살이기도 하고.

Ronald Opus가 문제의 9층 창문을 지날 때, 그 방에서는 노 부부 두사람이 심하게 다투고 있었다. 남편이 홧김에 Shot Gun을 집어 들어 발사했지만 너무 화나고 흥분한 나머지 총알은 wife를 맞추지 못하고 빗나가 창문을 뚫고 나간 것.그런데, 법정에서 이 노부부가 (wife도 포함해서) 주장하기를, 남편이 화가 나면 항상 Shot Gun 을 들어서 wife를 위협하는 것이 버릇이고, Shot Gun에는 늘 총알을 넣어 놓지 않는다는 것이다. wife를 실제로 죽일 의사는 애당초 없다는 거다. 따라서 Opus씨의 죽음은 살인이 아니라 실수로 Shot Gun이 장전됐으니 사고사가 될 것이고.

그런데, 계속된 수사 결과 그 총을 장전한 것은 노 부부의 아들이었다는 것이 목격자를 통해 드러 났다. 그 노부부는 아들에게 경제적인 도움을 주어 왔는데, 요즘들어 어머니가 도움을 끊어 버렸고, 아버지가 화만 나면 빈 총으로 어머니를 위협하는 버릇이 있다는 걸 아는 아들이 몰래 총을 장전해 놓은 거다. 부부 싸움 때에 아버지의 버릇이 나오면 어머니가 아버지 총에 맞아 죽기를 바랬던 것. 그러면 이제 Opus 씨의 죽음은 사고사가 아닌 노부부의 아들에 의한 살인이 되나?

그런데, 수사 결과 노부부의 아들이 실제로 Ronald Opus 였다는 사실이 밝혀졌다. 여러 가지 고민으로 자살 하려다 결국 자신이 장전한 총에 맞아 숨진 것이다. 자살, 타살, 사고사, 타살 로 오락가락하던 이 사건은 결국 자살로 종결됐다는 얘기다. 안전 그물로 인해 그의 자살이 무위로 돌아 갈 번했지만, 결국은 기가 막힌 운명으로 그는 자살하려던 자신의 운명을 좇게 됐다는 그런 얘기다.

우리, 니네 운명은 운명이고, 그냥 열심히 살자구.

If at first you don't succeed.... fate will step in....

Truth is stranger than fiction.....

At the 1994 annual awards dinner given for Forensic Science, A past president, Dr. Don Harper Mills astounded his audience with the legal complications of a bizarre death. Here is the story:

On March 23, 1994 the medical examiner viewed the body of Ronald Opus and concluded that he died from a shotgun wound to the head. The decedent had jumped from the top of a ten story building intending to commit suicide. He left a note to that effect indicating his despondency. As he fell past the ninth floor, his life was interrupted by a shotgun blast passing through a window, which killed him instantly. Neither the shooter nor the decedent was aware that a safety net had been installed just below at the eighth floor level to protect some building workers and that Ronald Opus would not have been able to complete his suicide the way he had planned.

Ordinarily, Dr. Mills continued, "a person who sets out to commit suicide and ultimately succeeds, even though the mechanism might not be what he intended" is still defined as committing suicide.

Mr. Opus was shot on the way to certain death nine stories below at street level, but that his suicide attempt probably would not have been successful because of the safety net, caused the medical examiner to feel that he had a homicide on his hands.

An elderly man and his wife occupied the room on the ninth floor from whence the shotgun blast emanated. They were arguing vigorously, and he was threatening her with a shotgun. The man was so upset that when he pulled the trigger he completely missed his wife and the pellets went through the window striking Mr. Opus.

When one intends to kill subject A, but kills subject B in the attempt, one is guilty of the murder of subject B. When confronted with the murder charge, the old man and his wife were both adamant. They both said they thought the shotgun was unloaded. The old man said it was his long standing habit to threaten his wife with the unloaded shotgun. He had no intention to murder her. Therefore, the killing of Mr. Opus appeared to be an accident, that is, the gun had been accidentally loaded.

The continuing investigation turned up a witness who saw the old couple's son loading the shotgun about six weeks prior to the fatal accident. It transpired that the old lady had cut off her son's financial support and the son, knowing the propensity of his father to use the shotgun threateningly, loaded the gun with the expectation that his father would shoot his mother.

The case now becomes one of murder on the part of the son for the death of Ronald Opus. Now comes the exquisite twist.

Further investigation revealed that the son was in fact Ronald Opus. He had become increasingly despondent over the failure of his attempt to engineer his mother's murder. This led him to jump off the ten story building on March 23rd, only to be killed by a shotgun blast passing through the ninth story window. The son had actually murdered himself so the medical examiner closed the case as a suicide.

Very tidy of him.
